§ 38-175. Odors from containers.

  • It shall be unlawful for any person to maintain a bin, receptacle or other container utilized for the collection, processing or managing of compostable materials in such a manner or location as to cause noxious or offensive odors which interfere with the use of neighboring property. If any person places or maintains a compost container on his property which emits noxious or offensive odors in violation of this section, the town may order the property owner to remove the compost and container from the property. Following the issuance of such order, the person shall be punished as provided in section 1-7 for each day the container remains on the property.
